How much does it cost to file for divorce in California?

It costs between $435 and $450 to file, depending on the county you live in.

How long does a divorce take?

The process takes at least six months, but it can take longer depending on the complexity of your case.

Can you divorce without splitting assets?

It's possible, but regardless of whether you and your partner agree to split assets, it must be approved by a judge.

Who pays child custody fees in California?

Each parent is responsible for paying their own attorney's fees.

How does child custody work in California?

The courts will determine custody and parenting time based on what they believe serves the child's best interests. They will finalize parenting plans specifying physical custody (the parent with whom the child lives), legal custody (who makes important decisions such as schooling and health care), and parenting time (visitation). An attorney can help make your position understood regarding what your child's best interests are and how they can be met.

Is mediation required?

Only if you and the child's other parent cannot reach a child custody agreement on your own. 

Who pays child support in a 50/50 custody agreement?

This is ultimately up to the courts, but if one parent earns significantly more than the other, that parent will likely be required to pay child support.

Alimony FAQ

How is alimony determined in California?

California courts determine spousal support according to one spouse's needs and the other's capacity to pay. The amount owed will depend on a number of factors, including how long the marriage lasted.

How is alimony calculated? 

It depends on whether it is considered temporary or long-term. Temporary alimony is often 40% of the higher-earning spouse's net monthly income minus 50% of the lower-earning spouse's income. Long-term alimony is far more complex and instead focuses on the duration of the marriage, support given by one spouse to the other while in school, the age and health of both parties, and much more.

Is alimony taxable?

The federal government does not tax alimony if your agreement was finalized after December 31, 2018. The State of California does tax alimony, no matter when the courts approved your agreement.

How long is alimony paid?

The guiding principle is that support should last a reasonable amount of time that would allow a lower-earning spouse to become able to support themselves—usually half the duration of the marriage. If the marriage lasted more than 10 years, the courts do not assume what is reasonable, and alimony may be paid for many years.
